Recent Cases: Criminal Law

Here are some recent highlights of criminal law cases handled by Auger Hollingsworth:

Impaired Driving -- In September 2007, charges of both impaired driving and driving over 80 were dropped against our client before trial. Our client now has no criminal record and did not lose his driver’s license.

Tax Evasion -- Our client faced very serious sanctions for a significant tax evasion. We successfully argued that a search warrant that the Crown relied on was in breach of the Charter. The charges were withdrawn.

Spousal Assault and Resist Arrest -- Our client received no criminal record when these charges were resolved.

Criminal Harassment -- In September 2006, we helped our client resolve seven charges of criminal harassment for no criminal record.

Failure to Appear -- In September 2006, we negotiated a withdrawal of this charge which was obtained when another law firm failed to notify the client of his trial date.

Weapons/ Assault / Mischief -- In September 2006, we resolved 5 charges against our client, including a serious weapons charge, for no criminal record.

Domestic Assault -- In August 2006, we won an appeal of a conviction for assault our client received at a trial handled by another firm. Our client is now entitled to a new trial.

Trespassing -- Our clients were eight individuals who had been charged with, and convicted of, trespassing while another law firm was handling their files. We were retained to appeal the convictions. In April 2006, we were successful in having the convictions set aside. In August 2006 we obtained a complete withdrawal of all of the original charges.

Breach of Recognizance and Possession of Marijuana -- In May 2006 we obtained a withdrawal of the breach and a stay of the drug charge in the Gatineau, Quebec court.

Sexual Assault -- In March 2006 we resolved a sexual assault charge for no criminal record.

Armed Robbery -- In February 2006 our client was acquitted of armed robbery after several weeks of trial.

Mischief -- In January 2006 we had the charges withdrawn against our client charged with mischief.

Causing a Disturbance -- In January 2006 we secured the dismissal of the charge against our client on the morning of trial.

First Degree Murder -- In October 2005, we acted as co-counsel on the first, first degree murder acquittal by an Ottawa jury in almost 10 years.

Sexual Assault by a Physician -- In the Fall of 2005, we secured the withdrawal of the charges against a physician charged with sexual assault by a patient.
