Recent Cases: Civil Litigation & Employment law
Here are some recent highlights of civil litigation and employment law cases handled by Auger Hollingsworth:
Employment -- In April 2008, we settled a case for an employee who was wrongfully terminated. The client received notice equivalent to 8 months' pay, as well as other confidential consideration.
Personal Injury -- We recently settled a claim by a child who was struck while on a bicycle for significant damages. This case languished in another lawyer's filing cabinet for a year and a half before we took it over and salvaged it for the client.
Accident Benefits -- Our client was denied much needed attendant case moneys for 7 months. We mediated and the insurer paid the whole amount.
Accident Benefits -- The insurer refused to pay thousands of dollars of visitors' expenses incurred while our catastrophically injured client was at the rehabilitation centre. We mediated the claim and the insurer agreed to pay.
Defamation -- In January 2008, we quashed an appeal from a successful decision we obtained that absolute privilege does not protect defamatory false accusations made to the police.
Sexual Assault -- In September 2007 we settled a historical sexual assault case for our client for well into 6 figures, without having to start a law suit.
Debt Collection -- In January 2007, our client received payment of 100% of the debt owing to her, plus legal costs, immediately after we served our statement of claim starting the law suit.
Business Dispute –- In November 2006, we negotiated the settlement of a claim
against our client for less than one-tenth of the original demand, with minimal
legal costs and in an extremely short time period.
Shareholder Dispute -- In September 2006, we successfully obtained a Court order imposing a shot-gun buy-sell mechanism among two equal shareholders where one of the shareholders strenuously resisted the order. Our client also received a substantial award of legal costs.
Defamation -- In August 2006, the author of a defamatory internet newsletter
removed the offending item from its website upon receiving our demand letter.
Discrimination and Constructive Dismissal -- In July 2006, we negotiated a
significant settlement for our client who was harassed at work while pregnant.
Internet Harassment -- In July 2006 we obtained an Order against a large telecommunications company requiring them to divulge the name of the individual who sent a secret, harassing email to our client under a pseudonym.
Personal Injury -- In June 2006 we negotiated a favorable settlement for our
client who sustained a shoulder injury in a motor vehicle accident without
having to start a law suit.
Wrongful Dismissal -- In June 2006, the Court awarded our client 4.5 months'
pay in lieu of notice, plus costs and interest, where the employer had only
offered two weeks.
Internet Harassment -- In May 2006 we obtained an Order requiring a web-page
operator to disclose the identities of certain internet users who were posting
defamatory statements on an internet forum.
Wrongful Dismissal -- In May 2006 we negotiated an increased notice period
from 6 weeks to 19 weeks for a terminated employee.
Debt Collection -- In May 2006 we obtained judgment for $65,500.00 in favour
of our client, representing the full amount of the debt, plus costs.
Sexual Assault -- In April 2006 we negotiated a settlement for our client who
was a victim of sexual abuse as a child in the amount of $275,000.00.
Wrongful Dismissal -- In March 2006, we obtained a settlement on behalf of an employer who terminated its employee for nominal damages only.
Malicious Prosecution -- In March 2006, we obtained a dismissal of an action commenced against our client before having to file a statement of defence.
Wrongful Dismissal -- In August 2005, we obtained a $72,000.00 settlement for our client whose employer had initially stated that the termination was for cause and nothing was due.
