Administrative Law
Richard and Brenda have significant experience dealing with cases where
individuals and businesses face off against various branches of the government.
"Sometimes, you can fight City Hall…or the Provincial Government or
the Federal Government or a Regulator or a Licensing Body…"
Public Inquiries
We have represented prominent figures in important public inquiries and hearings. Richard recently represented a prominent person in nationally-televised hearings before the Parliamentary Ethics Committee. In 2007, Richard represented a person required to testify before the Public Accounts Committee while Brenda provided advice and counsel to a Senate committee conducting a hearing. In 2004 and 2005 Richard Auger represented a key witness on the Gomery Inquiry. In 2003 and 2004, Richard presented another player in the Toronto Leasing Inquiry.
Licensing
Whether it is a liquor license, agent, broker, motor vehicle dealer or
other business license, an adverse decision by a regulator can have
significant financial impact on your business. Both Richard and Brenda
have successfully represented clients in cases against Ontario licensing
bodies. We also regularly help our clients who are advancing complaints to professional licensing bodies.
Judicial Review
Generally, when the government makes a decision that affects your
rights, there are rules of fairness and natural justice it must follow.
Brenda and Richard have both acted on behalf of clients applying to the
court to have a government decision reviewed.
Other administrative law issues Brenda and Richard handle include:
- professional discipline matters
- applying for pardons of criminal charges
- attending at coroner's inquests
- criminal victim compensation applications
